Platform Terms of Use

1. Acceptance of Terms

These Terms & Conditions (the "Terms") constitute a binding agreement between you ("User," "you," or "your") and MatureSearch ("MatureSearch," "we," "us," or "our") governing your access to and use of the website located at jaxbluewaterclub.com and any associated services, features, or content (collectively, the "Platform"). By accessing the Platform, creating an account, or clicking any button indicating agreement, you affirm that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy and Cookie Policy, which are incorporated herein by reference. If you do not agree to these Terms, you must not access or use the Platform.

Your consent to the processing of personal data is addressed separately in the Privacy Policy and, where cookie-based, in the Cookie Policy. In accordance with the principle that a consent request embedded within a broader written agreement must be presented in a manner clearly distinguishable from other matters, acceptance of these Terms does not itself constitute consent to any optional data processing activity; such consent, where required, is requested through a distinct and freely given mechanism.

2. Eligibility & 18+ Age Requirement

Use of the Platform is strictly limited to individuals who are at least eighteen (18) years of age. By registering for or using the Platform, you represent and warrant that you are at least 18 years old and that you possess the legal capacity to enter into a binding agreement under the laws of your jurisdiction of residence. MatureSearch does not knowingly permit access by minors, and any account found or suspected to belong to an individual under 18 years of age will be suspended and terminated without notice.

You further represent that your use of the Platform does not violate any law or regulation applicable to you, including but not limited to laws governing adult content, dating services, or data protection in your jurisdiction. MatureSearch reserves the right to request age verification documentation at any time and to deny or revoke access where such verification is not satisfactorily provided.

3. Account Registration & User Responsibilities

To access certain features of the Platform, you must create an account by providing accurate, current, and complete information. You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account, whether or not authorized by you. You agree to notify MatureSearch promptly of any unauthorized use of your account or any other breach of security.

You agree that you will:

• Provide truthful information during registration and keep your profile reasonably current;
• Use only one active account unless otherwise authorized in writing by MatureSearch;
• Refrain from sharing your account credentials with any third party;
• Immediately cease use of the Platform if you no longer meet the eligibility requirements set out in Section 2.

MatureSearch is not liable for any loss or damage arising from your failure to comply with the obligations set out in this Section.

4. Acceptable Use & Prohibited Conduct

As a condition of your continued access to the Platform, you agree not to engage in any of the following prohibited activities:

• Impersonating another person or creating a profile using another individual's likeness without consent;
• Uploading content that is unlawful, defamatory, harassing, obscene beyond what is appropriate for an adult dating context, or that infringes the rights of a third party;
• Soliciting payment, engaging in commercial solicitation, or advertising unrelated goods or services through the Platform;
• Using automated means, including bots, scrapers, or scripts, to access, extract data from, or interact with the Platform;
• Harassing, threatening, stalking, or attempting to coerce another User;
• Circumventing, disabling, or otherwise interfering with security-related features of the Platform;
• Using the Platform for any purpose that is illegal under applicable law, including human trafficking or the exploitation of minors.

MatureSearch reserves the right, but does not assume the obligation, to monitor use of the Platform and to investigate any suspected violation of this Section. Violation of this Section may result in immediate suspension or termination of your account pursuant to Section 11.

5. User-Generated Content & Profiles

"User Content" means any photograph, text, message, or other material that you submit, post, or transmit through the Platform, including your profile information. You retain ownership of your User Content, but by submitting it you grant MatureSearch a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, display, and distribute such content solely for the purpose of operating, promoting internally, and improving the Platform.

You represent and warrant that:

• You own or have the necessary rights to all User Content you submit, including any photographs depicting yourself;
• Your User Content does not infringe the intellectual property, privacy, or publicity rights of any third party;
• Your profile photographs are genuine, current, and depict you accurately, in accordance with our photo-review process.

Profile photographs are subject to a review process prior to publication. MatureSearch reserves the right to reject, remove, or request replacement of any User Content that does not comply with these Terms, at its sole discretion and without obligation to provide a detailed explanation.

6. Subscriptions, Billing Disclosure & Discreet Billing Notice

Certain features of the Platform may be offered as paid upgrades or subscriptions. Where applicable, pricing, billing frequency, and renewal terms are disclosed to you prior to purchase at the point of transaction. By authorizing a purchase, you agree to the pricing and renewal terms presented to you at that time.

Transactions processed through the Platform may appear on your payment statement under a discreet billing descriptor that does not explicitly reference MatureSearch or the nature of the service, in order to preserve the privacy of Users. You acknowledge that the appearance of a generic descriptor does not relieve you of responsibility for charges you have authorized.

Subscriptions, where offered, may renew automatically at the end of each billing period unless cancelled prior to the renewal date through your account settings or by contacting support. You are responsible for reviewing renewal terms at the time of purchase and for cancelling in advance of renewal if you do not wish to continue. MatureSearch does not guarantee refunds for partial subscription periods except where required by applicable law.

Access to the core browsing functionality of the Platform is not conditioned upon your consent to non-essential data processing. Consistent with the principle that use of a service should not be made conditional on consent to processing that is not necessary for performance of the underlying contract, declining optional cookie categories or marketing communications, as described in the Cookie Policy, does not affect your ability to use paid features for which you have separately contracted.

7. Intellectual Property

All content on the Platform other than User Content, including but not limited to the MatureSearch name, logo, design elements, source code, and compiled software, is the property of MatureSearch or its licensors and is protected by applicable intellectual property laws. Nothing in these Terms grants you any right, title, or interest in such materials except the limited right to access and use the Platform in accordance with these Terms.

You may not copy, modify, distribute, sell, lease, reverse-engineer, or create derivative works based on the Platform or any portion of it without the prior written consent of MatureSearch.

8. Disclaimers & No Guarantee of Matches

The Platform is provided on an "as is" and "as available" basis. MatureSearch makes no representation or warranty, express or implied, regarding the accuracy, reliability, or completeness of any User profile, and does not guarantee that use of the Platform will result in a successful match, a meeting, or any particular outcome.

You acknowledge that interactions with other Users occur at your own discretion and risk. MatureSearch does not conduct criminal background checks on Users and disclaims any responsibility for the conduct, whether online or offline, of any User. You are solely responsible for exercising reasonable caution and judgment, including when arranging to meet another User in person.

To the fullest extent permitted by applicable law, MatureSearch disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the maximum extent permitted by applicable law, MatureSearch, its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your access to or use of, or inability to access or use, the Platform, whether based on contract, tort, strict liability, or any other legal theory, even if MatureSearch has been advised of the possibility of such damages.

In jurisdictions that do not permit the exclusion or limitation of certain damages, the above limitations apply only to the extent permitted by applicable law. The aggregate liability of MatureSearch for any claim arising under these Terms shall not exceed the amount, if any, paid by you to MatureSearch during the twelve (12) months preceding the event giving rise to the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless MatureSearch and its officers, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with: (a) your access to or use of the Platform; (b) your violation of these Terms; (c) your violation of any applicable law or the rights of a third party; or (d) any User Content you submit.

11. Suspension & Termination of Accounts

MatureSearch reserves the right to suspend or terminate your account, with or without notice, if we determine, in our sole discretion, that you have violated these Terms, engaged in conduct harmful to other Users or to the Platform, or provided false information during registration. You may also terminate your account at any time through your account settings or by contacting support; upon termination, your right to use the Platform ceases immediately.

Sections of these Terms that by their nature are intended to survive termination, including Sections 7 through 10 and 12, shall continue to apply following termination of your account. Deletion of account data following termination is addressed in the Privacy Policy.

12. Dispute Resolution & Governing Law

These Terms and any dispute arising out of or related to your use of the Platform shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict-of-laws principles. The parties agree to first attempt to resolve any dispute informally by contacting MatureSearch support in good faith before pursuing formal proceedings.

If a dispute cannot be resolved informally, it shall be resolved through the appropriate legal channels available under United States law, in the forum and manner permitted by applicable jurisdictional rules. Nothing in this Section limits any right either party may have to seek relief available to consumers under mandatory applicable law.

13. Changes to These Terms

MatureSearch may revise these Terms from time to time to reflect changes in our practices, services, or applicable law. Material changes will be indicated by updating the "Last updated" date at the top of this page. Your continued use of the Platform following the posting of revised Terms constitutes your acceptance of those changes. We encourage you to review these Terms periodically.
